für den Online-Shop und die Freudenstücke Academy

1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge, die zwischen Freudenstücke, Inhaberin Alexandra Wilfling, und ihren Kunden über die Website abgeschlossen werden.
Sie gelten sowohl für den Verkauf handgefertigter Kerzen und weiterer physischer Produkte als auch für digitale Inhalte der Freudenstücke Academy, insbesondere Online-Kurse, Videos, Downloads und Arbeitsmaterialien.
Abweichende Geschäftsbedingungen des Kunden finden keine Anwendung, sofern ihrer Geltung nicht ausdrücklich schriftlich zugestimmt wurde.

3. Vertragsabschluss
Die Darstellung der Produkte und digitalen Inhalte auf der Website stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Abgabe einer Bestellung.
Mit Abschluss des Bestellvorgangs gibt der Kunde ein verbindliches Angebot zum Abschluss eines Kaufvertrages ab.
Der Vertrag kommt erst mit Annahme der Bestellung zustande.
Bei digitalen Kursen erfolgt die Annahme regelmäßig durch die Freischaltung des gebuchten Kurses.
4. Preise und Zahlung
Es gelten die zum Zeitpunkt der Bestellung auf der Website angegebenen Preise.
Die Zahlung erfolgt über die im Bestellprozess angebotenen Zahlungsmethoden. Die Zahlungsabwicklung erfolgt über Wix Payments oder einen der dort angebotenen Zahlungsdienstleister.
Der Zugang zu digitalen Inhalten sowie der Versand physischer Produkte erfolgt grundsätzlich erst nach erfolgreichem Zahlungseingang.
5. Digitale Inhalte der Freudenstücke Academy
Nach erfolgreicher Zahlung erhält der Käufer Zugriff auf den erworbenen Online-Kurs.
Der Zugang wird auf unbestimmte Zeit bereitgestellt. Ein Anspruch auf eine lebenslange Verfügbarkeit besteht jedoch nicht.
Freudenstücke behält sich vor, die Academy ganz oder teilweise einzustellen, sofern der Geschäftsbetrieb dauerhaft beendet wird oder eine Fortführung aus technischen, wirtschaftlichen oder rechtlichen Gründen nicht mehr möglich oder zumutbar ist.
In diesem Fall besteht kein Anspruch auf eine weitere Bereitstellung der digitalen Inhalte.
6. Aktualisierungen der Kursinhalte
Die Inhalte der Freudenstücke Academy werden regelmäßig überprüft und bei Bedarf aktualisiert oder erweitert.
Aktualisierungen, die Bestandteil des erworbenen Kurses sind, werden den Teilnehmern ohne zusätzliche Kosten zur Verfügung gestellt.
Neue eigenständige Kurse, Spezialkurse oder saisonale Projekte (z. B. Weihnachts- oder Osterkurse) sind nicht Bestandteil des ursprünglichen Kaufvertrages und können gesondert angeboten werden.
7. Nutzung der Freudenstücke Academy
Der Zugang zur Freudenstücke Academy ist ausschließlich für die Person bestimmt, die den Kurs erworben hat.
Die Weitergabe von Zugangsdaten an Dritte ist nicht gestattet.
Eine gemeinsame Nutzung eines Accounts durch mehrere Personen ist unzulässig. Bei einem begründeten Verdacht auf eine missbräuchliche Nutzung oder Weitergabe der Zugangsdaten behält sich Freudenstücke das Recht vor, den Zugang vorübergehend oder dauerhaft zu sperren.
8. Urheberrecht und Nutzungsrechte
Sämtliche Inhalte der Freudenstücke Academy, insbesondere Videos, Texte, Bilder, Downloads, Arbeitsblätter, Rezepturen, Formeln und sonstige Lernmaterialien, sind urheberrechtlich geschützt.
Der Erwerb eines Kurses berechtigt ausschließlich zur persönlichen Nutzung.
Nicht gestattet sind insbesondere:

die Weitergabe oder Veröffentlichung von Kursinhalten,

das Kopieren oder Vervielfältigen der Inhalte außerhalb des gesetzlich Zulässigen,

Bildschirmaufnahmen, Audio- oder Videoaufzeichnungen der Kursinhalte,

das Hochladen der Inhalte auf Internetseiten, soziale Netzwerke oder Videoplattformen,
-
die Nutzung der Inhalte zur Erstellung eigener Kurse, Schulungen, Bücher oder vergleichbarer Angebote,
-
das Auslesen, Analysieren oder Verwenden der Inhalte mithilfe von Software oder Systemen künstlicher Intelligenz zur Erstellung eigener Werke oder Produkte.
Die bereitgestellten Downloads dürfen ausschließlich für den eigenen privaten Gebrauch gespeichert und ausgedruckt werden.
Eine Weitergabe, Veröffentlichung oder gewerbliche Nutzung der Downloads oder Kursunterlagen ist nicht gestattet.
Die im Kurs vermittelten Techniken dürfen zur Herstellung und zum Verkauf eigener Kerzen verwendet werden.
Die im Kurs enthaltenen Rezepturen, Anleitungen und Unterlagen dürfen jedoch nicht veröffentlicht, weitergegeben oder als eigene Inhalte verbreitet werden.
9. Lieferung physischer Produkte
Die Lieferung physischer Produkte erfolgt an die vom Kunden angegebene Lieferadresse.
Die Lieferzeit ergibt sich aus der jeweiligen Produktbeschreibung.
Sollte ein Produkt ausnahmsweise nicht verfügbar sein, wird der Kunde hierüber unverzüglich informiert.
10. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte.
11. Haftung
Freudenstücke haftet nach den gesetzlichen Vorschriften für Schäden, die auf vorsätzlichem oder grob fahrlässigem Verhalten beruhen. Im Übrigen gelten die gesetzlichen Haftungsregelungen.
Die im Rahmen der Freudenstücke Academy vermittelten Inhalte dienen der Wissensvermittlung. Die praktische Umsetzung erfolgt eigenverantwortlich durch den Teilnehmer.
Die Inhalte wurden nach bestem Wissen erstellt. Eine Gewähr für Vollständigkeit und Fehlerfreiheit kann jedoch nicht übernommen werden.
Beim Arbeiten mit Wachs, Duftstoffen, Farben, Gießpulver, Epoxidharz oder anderen Materialien sind die jeweiligen Sicherheits- und Verarbeitungshinweise der Hersteller zu beachten. Die praktische Umsetzung der im Kurs vermittelten Inhalte erfolgt eigenverantwortlich. Jeder Teilnehmer ist für sein Handeln sowie für die Einhaltung der geltenden Sicherheitsvorschriften selbst verantwortlich.
Trotz sorgfältiger Erstellung der Kursinhalte kann keine Garantie für einen bestimmten Erfolg, ein bestimmtes Arbeitsergebnis oder einen wirtschaftlichen Erfolg übernommen werden.
12. Widerrufsrecht
Verbrauchern steht grundsätzlich ein gesetzliches Widerrufsrecht zu.
Einzelheiten ergeben sich aus der gesonderten Widerrufsbelehrung auf dieser Website.
Für digitale Inhalte können besondere gesetzliche Regelungen zum Erlöschen des Widerrufsrechts gelten, sofern der Kunde ausdrücklich zustimmt und die gesetzlichen Voraussetzungen erfüllt sind.
13. Schlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts, soweit gesetzlich zulässig.
Sollte eine Bestimmung dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

1. Scope of Application
These Terms and Conditions (T&C) apply to all contracts concluded via this website between Freudenstücke, owned and operated by Alexandra Wilfling, and its customers.
They apply both to the sale of handmade candles and other physical products, as well as to the digital content offered through the Freudenstücke Academy, including online courses, videos, downloads, and learning materials.
Any conflicting or deviating terms and conditions of the customer shall not apply unless Freudenstücke has expressly agreed to them in writing.

3. Conclusion of Contract
The presentation of products and digital content on this website does not constitute a legally binding offer but rather an invitation to place an order.
By completing the checkout process, the customer submits a binding offer to conclude a purchase agreement.
The contract is concluded only when the order has been accepted by Freudenstücke.
For digital courses, acceptance generally takes place by granting access to the purchased course.
4. Prices and Payment
The prices displayed on the website at the time of purchase shall apply.
Payment is made using the payment methods offered during the checkout process. Payments are processed through Wix Payments or one of the payment service providers available through Wix.
Access to digital content and shipment of physical products will generally only take place after successful receipt of payment.
5. Digital Content of the Freudenstücke Academy
Upon successful payment, the purchaser will receive access to the purchased online course.
Access is provided for an indefinite period. However, there is no entitlement to lifetime availability.
Freudenstücke reserves the right to discontinue the Academy, in whole or in part, if the business is permanently discontinued or if continued operation is no longer possible or reasonable due to technical, economic, or legal reasons.
In such cases, there shall be no entitlement to continued access to the digital content.
6. Course Updates
The content of the Freudenstücke Academy is regularly reviewed and may be updated or expanded as needed.
Updates that form part of the purchased course will be made available to participants at no additional cost.
New standalone courses, specialty courses, or seasonal projects (such as Christmas or Easter courses) are not part of the original purchase agreement and may be offered separately.
7. Use of the Freudenstücke Academy
Access to the Freudenstücke Academy is strictly personal and may only be used by the individual who purchased the course.
Sharing login credentials with third parties is prohibited.
The use of a single account by multiple individuals is not permitted.
If there is reasonable suspicion of unauthorized use or sharing of login credentials, Freudenstücke reserves the right to temporarily suspend or permanently deactivate the account.
8. Copyright and License of Use
All content provided through the Freudenstücke Academy—including, but not limited to, videos, texts, images, downloads, worksheets, recipes, formulas, and other educational materials—is protected by copyright.
The purchase of a course grants the customer a personal, non-transferable license for private use only.
The following actions are expressly prohibited:

Sharing or publishing course content.

Copying or reproducing course materials beyond what is permitted by law.

Creating screen recordings, audio recordings, or video recordings of the course content.

Uploading course content to websites, social media platforms, or video-sharing services.

Extracting, analyzing, processing, or using the content with software or artificial intelligence (AI) systems to create new works, products, or commercial offerings.
Downloads provided as part of the course may only be saved and printed for the purchaser's own private use.
The distribution, publication, resale, or commercial use of downloads or course materials is prohibited.
The techniques taught in the course may be used to create and sell your own handmade candles.
However, the recipes, instructions, formulas, and educational materials provided within the course may not be published, shared, reproduced, or distributed as your own content.
9. Delivery of Physical Products
Physical products will be shipped to the delivery address provided by the customer.
Delivery times are stated in the respective product description.
Should a product exceptionally become unavailable, the customer will be informed without undue delay.
10. Warranty
The statutory warranty rights shall apply.
11. Liability
Freudenstücke shall be liable in accordance with the applicable statutory provisions for damages resulting from intentional misconduct or gross negligence. In all other respects, the statutory liability provisions shall apply.
The content provided through the Freudenstücke Academy is intended solely for educational purposes. The practical application of the knowledge taught is carried out at the participant's own responsibility.
The course content has been prepared with the greatest possible care and to the best of our knowledge. However, no guarantee is given regarding its completeness, accuracy, or freedom from errors.
When working with wax, fragrance oils, dyes, casting compounds, epoxy resin, or any other materials, participants must always follow the respective manufacturer's safety instructions and processing guidelines.
Each participant is solely responsible for their own actions, safety, and compliance with all applicable safety regulations.
Although every effort has been made to ensure the quality of the course content, Freudenstücke does not guarantee any specific outcome, work result, or commercial success.
12. Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal.
Details can be found in the separate Right of Withdrawal Policy available on this website.
For digital content, special statutory provisions regarding the expiration of the right of withdrawal may apply, provided the customer has given the required express consent and the applicable legal requirements have been fulfilled.
13. Final Provisions
These Terms and Conditions shall be governed by the laws of the Federal Republic of Germany, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by law.
Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
These Terms and Conditions are governed by the laws of the Federal Republic of Germany.
